The court record includes an inventory of items, a list of who they were sold to, and the price that each one brought at auction. Most items seemed to go to Lear? Cullipher (presumed widow). Several other items went to Rachael Cullipher and Rebecca Cullipher, and some to Griffen Sawyer and Abel Sawyer. Estate inventory was December 1814 and sale was January 1815. It is an assumption that the Rachael Cullipher who purchased items at this sale was the Rachael who was the mother of James Cullipher. It is possible there was some other relationship (such as her being an unmarried daughter or niece) or no close relationship at all. Records also appear to indicate a sale to Mark Sawyer.

    Tyrrell County, North Carolina
Petition of 1779 to Form a New County

To The Honorable the Senate and Commons of North Carolina in General Assembly the Petition of the Inhabitants of Tyrrell County Sheweth --------------

That the County of Tyrrell aforesaid from the line which divides the same from Martin County to Stumpy Point is at least one hundred & twenty miles in length & intersected by several large Rivers Creeks & Deep Swamps which renders the attendance of your petitioners on Jurys & at General Musters & Elections intolerably burthensome & expensive as well as extreemly precarious from the uncertainty of being able to pass the above mentioned Rivers & Creeks by which your Petitioners are not only greatly oppressed & injured but the Business & publick Affairs of the County frequently impeded & delayed to the manifest prejudice of the State in General ------

Your Petitioners further shew that the Court House of the said County is situate about Seventy miles or more from the Eastern extremety of the said County & at least forty miles from the Western Boundary ------

Your petitioners therefore humbly pray that in consideration of the premises you will be pleased by Act of the General Assembly to cause the said County of Tyrrell to be divided into two distinct & separate Countys by a line run across the said County at Cypress Swamp about five miles above the present Courthouse of the said County, or as such other Manner as you in your wisdom shall think neet & convenient -----

Your Petitioners further pray that in case the said County be divided that you will be graciously pleased to order the Court House & Publick Buildings to be erected on the Eastern Part, that is to say that part of the County from Cypress Swamp to Stumpy Point, at the place calld & known by the name of the Fort Landing & that the Commissioners for the same may be John William Liverman, Mathew Driver Greeves, Joseph Pledger & Thomas Hopkins ------

And that the Western Part of said County so divided beginning at Cypress Swamp & extending to the Western Boundary be called & known by the name of Buncombe County & your Petitioners as in Duty bound will pray

    (ENDORSEMENT)

    Petition Tyrrell County

    Oct 1779

(The full list of names that appear on this petition is not included here. The original five signature pages were divided into three columns per page. The transcriber began transcribing each signature page at the top left and worked down the column, then started at the top of the middle column, and finally moved to the top of the right column. The process was repeated for each page. In this sense the transcriber hoped to keep groups of people together on the transcribed document. The transcribed document is a single column. This was the only way to allow the entered names to be sorted and thus arranged alphabetically for ease of use. Some areas of the signature pages were very faint resulting in "estimated" transcriptions. Those names are denoted by a (?) next to the entry.)

The name suggested for the proposed new county (Buncome) was later used for a county formed in western North Caroloina.

  • [S624] This footnote summarizes the logic behind the (tentative) conclusion embedded in this family tree that the elder of two Henry Culliphers is the spouse of Mary (--?--) Cullipher (her maiden name is not known as this is writtein in May 2010).

On Sept 4 2006, Dianna German Anderson sent Carl Fields a compilation of the Cullipher information via e-mail (including her conclusions about the identity of the four sons of the elder Henry Cullipher). In October 2006, Carl collected Cullipher estate information (and other court information) at the North Carolina Archives. He then attempted to figure out (possibly by process of elimination) who was the husband of Rachel (--?--) Cullipher (probable mother of Mary Cullipher Jarman, who was, in turn, the presumed mother of Josiah Jarman Sr).

The Dianna German information and the estate/court information can be summarized as folows:

Henry Cullipher Sr -- Spouse unknown (initially)
James Cullipher -- Spouse was Leah (based on documents in an e-mail sent by Carl Fields, dated 10/22/2006)
Henry Cullipher Jr -- Spouse was Ann Lucas -- married 1794 (from Dianna German, supported by info in at least one Oct/Nov e-mails by Carl Fields)
Isaac Lucas -- Spouse was Elizabeth Lucas -- married 1784 (from Dianna German)
John Cullipher -- Spouse was Pethenia? (based on documents in a Carl Fields e-mail dated 11/7/2006), or Theney (based on ifromation in a Carl Fields e-mail dated 10/26/2006); Theny probably an alternative spelling or a nickname. [The first letter of her name appears to me to be a "P" in the handwritten record. However, her name would "sound" better to Carl Fields if that first letter was a "B".]

From the above, Carl Fields concludes (guesses?) that Rachel was the wife of Henry Sr, making Rachel a sister (or maybe half-sister) to these others (the four identified sons). Carl does not have a date of birth for either Mary Cullipher (maiden name) or Rachel Cullipher (married name). However, if Josiah Jarman was born about 1780 (Dianna German's estimate), then Mary (presumably Josiah's mother) could have been married around 1778. This is in the ballpark of when Isaac and Elizabeth married (1784), Isaac and Mary MIGHT have been brother and sister based on those dates (one of the dates is essentially a guess, of course).

So, Carl Fields's best estimate (guess) (as of May 2010) is that Henry Cullipher Sr was married to a woman name Rachel. The basis for this conclusion is not robust. Several alternative possibilities exist.

There are three adjacent Jewish cemeteries at this location, some of which have had more than one name during their history (so the current name may not correspond to the name on, say, an older death certificate and burial record). The three cemeteries have separate gates and exterior wall designs (for the walls facing Florida Grove Road), but once inside a gate, there are (as of 2013) no internal barriers separating one cemetery from the others. Thus, in some cases, it is unclear which of the three cemeteries a specific grave "belongs" to. The three cemeteries appear to be inside the current (2013) city limits of Perth Amboy. However, they are probably close to a city limit and may be in an adjacent municipality. It is likely they were outside the Perth Amboy city limits (possibly in Woodbridge Township) at the time of the earliest burials. Also, the street name (Florida Grove Road in 2013) may have been different in a earlier era (e.g., circa1920s). The southwest corner of the cluster of three adjacent cemeteries is at the northwest corner of the intersection of Florida Grove Road and Bingle Street.

  • [S1113] The known history of Cullipher family member of interest here (to the limited extent that it is known) starts with a couple named Henry and Rachel Cullipher, and five offspring: Henry, Isaac, John, James, and Mary, all associated with Tyrrell County, North Carolina. This family structure is generally consistent with information obtained from Dianna German Anderson, via e-mail. Rachael's maiden name is unknown.

The approximate birth year listed for the elder Henry Cullipher (and, indeed, the name "Henry" for the father of a younger Tyrrell County Henry Cullipher) is also generally consistent with certain information in the International Genealogical Index (IGI) (North America) and Predigee Resource File (PRF) databases (url: http://www.familysearch.org/eng/search/frameset_search.asp -- this is part of a web site becoming known as "Old Family Search" as of early 2009). This birth year -- and the name Henry for the younger Henry's father -- are also consistent with certain information in the Rootsweb WorldConnect database (url: http://wc.rootsweb.ancestry.com). However, to the best knowledge of Carl C Fields (CCF) as of March 2009, robust documentation does not exist for the name or birth year of this older "Henry" Cullipher or for the structure of his immediate family.

The information outlined in the preceding paragraph inidcates that a Henry Cullipher was born ~1739 in Bertie County, NC and may have moved to Tyrrell County at some point in his life (the IGI and PRF databases mentioned above are examples of this "certain information"). However, other information on these same databases indicates that some people named Cullipher (including at least one person named Henry) lived in Bertie Couny into the 1790s (and later). Thus, it is possible that records for two separate Cullipher families (one in Tyrrell County and one in Berite County) have become intermingled.

The best items of evidence known to CCF for the existence of an "older" Henry Cullipher (older than the one who appears in Tyrrell County NC marriage records on 29 July 1794 in a marriage to Ann Lucas) are: (1) the existence of two entries for men named Henry Cullipher in the 1800 Tyrrell County NC census and (2) the existence of only one Henry Cullipher household (presumably the elder one) in the 1790 census (in this presumed scenario, the second Henry Cullipher is presumed to have not established a household in Tyrrell County until after his 1794 marriage).

Both of these individuals are listed as over age 45 (born prior to about 1755). However, one of the two llisted in the 1800 census appears to have fairly young children, while the other (presumably older one) does not (IS THIS TRUE). (This is, of course, not an extremely strong basis for establish even relative ages of individuals.

A Henry Cullipher appears in the 1790 census for Tyrrell County NC (ages of individuals cannot be determined from the 1790 census, except for for the number of males in a household older and younger than 16 years). Two individuals named Henry Cullipher appear in Tyrrell County NC in the 1800 census, but the available information indicates that neither of them is older than age 45 (corresponding to a birth around 1755). If this age information is correct, it is doubtful that either of them could be a father of this family. Based on the age deduced from the 1800 census, the 1790 and 1800 census data for Henry Cullipher of Tyrrell County are not assigned to this individual. However, it is not impossible that the census information for Henry Cullipher from those two censuses does indeed correspond to this individual. Similarly, there is no strong documentation confirming that all of the children listed here are indeed children of this individual.

    Washington County

For background information, prior to about 1799, the southeast portion of Bertie County and the Northwest portion of Tyrrell County were adjacent to one another. That ended around 1799 when Washington County was created from the western portion of Tyrrell County (later, about 1870, Dare County was created from the eastern portion of Tyrrell County and portions of certain other counties -- the current Tyrrell County is approximately the central 1/3 of the area making up original Tyrrell County when it was created in 1729). This information on county boundaries was drawn from the following two web sites in March 2009: url: http://en.wikipedia.org/wiki/… and http://www.familyhistory101.com/maps/nc_cf.html.

Even though the information on the web sites described in the preceding paragaraph indicates Washington County NC was created in 1799, records on Ancestry.com appear to not show any population numbers for Washington Co. NC in the 1800 census. However, information on the Washington County GenWeb site suggests that a combined census of Tyrrell and Washington counties was taken (and not completed until March 1801!). Results for Washington County have been separated out and are listed at url: http://patriot.net/~cpbarnes/WASH1800.HTM. No Cullipher or Jarman family members are listed on that Washington County web site for the 1800 census.

Isaac Cullipher ("Cullifer") apparently does appear on page 775 for the 1810 census (url: http://patriot.net/~cpbarnes/W1810775.HTM#77510) of Washington County with the count (1 1 2), which indicates no member of the household is above age 25 and there are no female members of the household. For 1820 the census for Washington County lists Elizabeth Cullipher (1 0 0 0 1 0 2 0 1 1 1) and Benjiman Cullipher (3 0 0 0 1 0 1 0 1 0 1), both on page 417 (url: http://patriot.net/~cpbarnes/W1820417.HTM#41738A). For each of these households, there is the supplemental information that one person is engaged in agriculture (none in commerce or manufacturing and no other persons, including foreigners not naturalized).

    Elizabeth Cullipher

There are also apparently two women with the married name of Elizabeth Cullipher in or near Tyrrell County in the early 1800s. One is the former Elizabeth Lucas (married to Isaac Cullipher). The other is a sister of Charles Spruill, who is mentioned in his 14 December 1814 will (Tyrrell County, Book 2, Page 69, url:http://patriot.net/~cpbarnes/SPRL1814.HTM). It is unclear who she was married to. It is possible that this sister of Charles Spruil is the same person as Elizabeth Lucas Cullipher if (for example) the marriage to Isaac Cullipher is her second marriage and she had an earlier marriage to a man named Lucas, or if she and Charles Spruil are half-siblings, with the same mother and different fathers.
